ChartFIG Terms of Service
Version 1
Effective date: October 23, 2026
These terms are an agreement between you and ChartFIG LLC, a North Carolina limited liability company, of 5540 Centerview Dr Ste 204, PMB 796970, Raleigh, North Carolina 27606-8012, United States ("ChartFIG", "we", "us"), about your use of the ChartFIG website, web app and related services (together, the "Service"). Please read them. They include a strong warning that ChartFIG is not investment advice (section 8), rules for the market data you see (section 9), and limits on our liability (sections 18 and 19).
1. Accepting these terms
1.1 You accept these terms when you tick the box to agree to them while creating an account, or when you use the Service. If you do not agree, do not use the Service.
1.2 Our Privacy Policy explains how we handle your personal information. It forms part of these terms.
1.3 Some features have extra terms shown in the app, such as the affiliate programme terms or any market data agreement an exchange requires you to accept. Those terms apply to that feature as well. If they conflict with these terms on that feature, the feature's own terms win.
2. Changes to these terms
2.1 We may update these terms. Each version has a number and an effective date at the top.
2.2 Material changes. If a change materially affects your rights or obligations (for example, how you are charged, what you may do with data, or how disputes are resolved), we will tell you in the app and by email before it takes effect, and you will be asked to accept the new version in the app before you continue using the Service. If you do not accept it, you can stop using the Service and cancel your subscription, as described in section 6.
2.3 Other changes. Changes that do not materially affect you, such as clearer wording, new features, or changes required by law or by an exchange, take effect when we publish them.
3. Who can use ChartFIG
3.1 You must be at least 18 years old and able to enter into a binding contract.
3.2 You may not use the Service if the law where you live forbids it, if you are subject to sanctions that prevent us from dealing with you, or if we have previously closed your account for breaking these terms.
3.3 If you use the Service for a company or other organisation, you confirm you are allowed to accept these terms for it. Note that market data used for a business is normally "professional" use (see section 9).
4. Your account
4.1 One person, one account. An account is for one named individual. You may not share your username or password, let anyone else use your account, or use one account on behalf of a group. You may not hold more than one account to get around limits, a suspension, or a free offer.
4.2 Accurate details. Give us accurate information when you sign up and keep your email address current. We use it to verify your account, reset your password and send you important notices.
4.3 Keeping it secure. Choose a strong password you do not use elsewhere and keep it private. You are responsible for what happens under your account. Tell us at support@chartfig.com straight away if you think someone else has used it.
4.4 Live updates in one place. For security and data-licensing reasons, live prices may run in only one browser tab or device at a time, and we may limit how many charts, streams, scripts or requests an account can use.
5. Plans
5.1 Free plan. The free plan shows market data delayed by 15 minutes and some features are locked. Delayed data is labelled as delayed. Anything calculated for a free account, including indicator output and paper-trade fills, uses the delayed data.
5.2 Paid plan. The paid plan gives real-time market data and unlocks paid features. The features in each plan are described in the app and may change over time.
5.3 Complimentary access. We may give some accounts paid features free of charge. We may end complimentary access at any time; the account then moves to the free plan unless you subscribe.
5.4 Changes to features. We are continually improving the Service and may add, change or remove features. If we remove a major paid feature during a period you have paid for, we will tell you, and you may cancel as described in section 6.
6. Subscriptions, billing and cancellation
6.1 How billing works. Paid plans are subscriptions billed in advance, monthly, through our payment processor, Stripe. By subscribing, you authorise us and our payment processor to charge your payment method at the start of each billing period until you cancel. The price and billing date are shown before you confirm.
6.2 Automatic renewal. Your subscription renews automatically each month unless you cancel before the renewal date.
6.3 Cancelling. You can cancel at any time from the "Manage billing" page in your account. Cancellation stops future charges. You keep paid features until the end of the period you have already paid for, then your account moves to the free plan.
6.4 Refunds. Except where the law requires otherwise, payments are not refundable, and we do not give refunds or credits for partial periods, unused time, or features you did not use. If we end your paid access without cause before a period you paid for has finished, we will refund the unused part of that period.
6.5 Failed payments. If a payment fails, we may retry it and ask you to update your card. If it is not resolved, your account may move to the free plan.
6.6 Price changes. We may change our prices. A new price applies to an existing subscription only from your next billing period after we have given you at least 30 days' notice by email or in the app. If you do not want to pay the new price, cancel before it takes effect.
6.7 Taxes. Prices may not include sales tax, VAT or similar taxes. Where we are required to collect them, they will be added and shown at checkout.
6.8 Exchange fees. Prices for real-time data assume you are a non-professional user (section 9). If you are or become a professional user, different fees set by the exchanges apply, and you agree to pay them (see section 9.6).
6.9 Chargebacks. If you dispute a valid charge with your bank instead of contacting us, we may suspend the account while the dispute is open.
7. Free plan and delayed data
7.1 Delayed data on the free plan is released 15 minutes after the time of each price, and is labelled as delayed. Do not rely on it as a current price.
7.2 The free plan is provided as it is, may change, and may be limited or withdrawn. The restrictions on market data in section 9 apply to delayed data too, except where an exchange's rules say otherwise.
8. Not investment advice
Please read this section carefully.
8.1 Tools and education only. ChartFIG provides charts, data, indicators and educational tools. Nothing in the Service is investment, financial, trading, tax or legal advice, and nothing in it is a recommendation or an offer to buy or sell any security, futures contract or other financial instrument, or a statement that any trade or strategy suits you.
8.2 We are not your adviser or broker. We are not a broker-dealer, futures commission merchant, introducing broker, commodity trading adviser, or investment adviser, and we are not registered as any of these. We do not execute trades, hold your money, or manage accounts. No relationship of adviser and client is created by your use of the Service.
8.3 Trading is risky. Trading stocks, futures and other instruments carries a substantial risk of loss and is not suitable for everyone. Futures are leveraged, and you can lose more than you deposit with your broker. Only trade with money you can afford to lose. Past performance does not predict future results.
8.4 Indicators, levels and signals are not predictions. Indicator lines, price levels, alerts, script results, coach levels, AI summaries and any similar output are mathematical or educational outputs. They can be wrong, late or missing, and they do not tell you what the market will do.
8.5 Paper trading and back-tests are hypothetical. Paper trading in ChartFIG is simulated. No real order is placed and no real money is at risk. Simulated and back-tested results have built-in limits: they are prepared with hindsight, do not reflect real fills, slippage, fees, liquidity or the emotional pressure of real trading, and are not indicative of results you would achieve with real money.
8.6 Other people's views. Coaches, teachers, other users and published scripts express their own views. We do not check or endorse them, and they are not advice from us.
8.7 Your decisions are yours. You are solely responsible for your own trading and investment decisions. Consider getting advice from a qualified, licensed professional before you trade.
9. Market data
9.1 Where the data comes from. Real-time and delayed futures data is supplied by CME Group exchanges through a licensed distributor. US stock data is supplied by US stock exchanges and other licensed sources. Each exchange and data provider owns its data, and we pass it to you under licences that require us to impose the rules in this section.
9.2 Personal, non-professional use only. Unless we have agreed otherwise with you in writing, you may use market data only for your own personal, non-commercial purposes, to view on your own screen. You may not:
- redistribute, resell, publish, broadcast or display the data to anyone else, in any form;
- export, download in bulk, copy into another program or database, or store the data outside the Service;
- use the data to create, calculate or publish any product, index, price or other data to be used by others, or to set prices for any other market or instrument;
- feed the data into automated trading, order-routing or other non-display systems;
- use the data to compete with us, a data provider or an exchange.
An occasional still image of your own chart, shared for personal, non-commercial discussion, is allowed unless we or an exchange tell you otherwise. It must never be used in place of a data service.
9.3 Who is a non-professional. In plain terms, you are a non-professional user only if all of the following are true:
- you are an individual using the data for yourself (or, where an exchange allows it, a small entity trading only its own money);
- you use the data only to manage your own personal money, not money belonging to anyone else, and not for a business;
- you are not registered or qualified as a professional trader, broker, investment adviser or similar with any securities or commodities regulator, any exchange or contract market, or any self-regulatory body;
- you are not a member of an exchange and do not hold or lease an exchange membership;
- you do not act as an investment adviser, commodity trading adviser or asset manager, and are not employed by or acting for a bank, broker, insurance company, investment firm or other financial institution in using the data;
- you do not give the data to anyone else, and you use it on no more devices than the exchange rules allow.
Anyone who does not meet all of these is a "professional" user. The exchanges make the final decision on whether a user is professional, and their definitions control if they differ from this summary.
9.4 Your declaration. By using real-time data you declare that you are a non-professional user. We may ask you to confirm this, to answer questions about how you use the data, or to accept an exchange's own subscriber agreement or certification in the app. If you do not, we may switch you to delayed data. Paid subscribers also accept our Real-Time Market Data Subscriber Agreement when they subscribe, which sets out these rules and the non-professional certification in full.
9.5 Tell us if your status changes. You must tell us at support@chartfig.com before you use real-time data as a professional, or straight away if you become a professional user (for example, if you take a job at a financial firm or register with a regulator).
9.6 Professional use. Professional use is allowed only under separate terms and fees agreed with us. If you use data as a professional without telling us, you agree to pay the difference between non-professional and professional exchange fees for the time you did so, and any related charges the exchanges impose.
9.7 Records and audits. Exchanges may require us to keep records of who receives their data and to report on it. You agree to give us accurate information we reasonably ask for in order to meet those duties, and you agree that we may share it with the relevant exchange or data provider.
9.8 Data may be wrong, late or interrupted. Market data may be delayed, inaccurate, incomplete, out of order or unavailable at times, including during busy markets. Exchanges, distributors or we may stop or change any data at any time. Do not rely on ChartFIG as your only source of prices, and check prices with your broker before you trade.
9.9 No liability of exchanges and data providers. The exchanges and data providers, and their affiliates, staff and licensors, do not guarantee the timeliness, order, accuracy or completeness of the data, make no promises about it, and are not liable to you for any loss arising from it or from any delay, error, omission or interruption, however caused. The exchanges are intended beneficiaries of this section and may enforce it.
9.10 Exchange rules prevail. Exchanges may change their rules for their data. Where an exchange's terms require something different from this section, the exchange's terms apply, and we may update this section to match.
10. News, calendars, company information and other third-party content
10.1 The Service shows content from third parties, such as news, economic and earnings calendars, company profiles and figures, and logos. We do not create, check or control that content.
10.2 Third-party content is provided "as is", for information only. It may be late, incomplete or wrong. Release times, forecasts and actual figures may change. We are not responsible for it, and its owners keep their rights in it. You may use it only within the Service, for your own use.
10.3 Links to other websites or services are for convenience. Some features open a service run by someone else inside the app, such as a trading journal. We are not responsible for those websites or services, and their own terms apply.
11. Our proprietary indicators and intellectual property
11.1 Ours. The Service, including its software, design, text, logos, the ChartFIG name, the Indigo language and its documentation, and our own indicators and tools such as KPL Pro, Trend Pro and Peachy ORB, belongs to us or our licensors and is protected by copyright, trade secret and other laws.
11.2 What you get. While you follow these terms, we give you a personal, limited, non-exclusive, non-transferable, revocable right to use the Service for your own use. For our proprietary indicators, you get their output on your charts. You do not get their formulas, methods or source code, and you have no right to them.
11.3 What you may not do. You may not, and may not help anyone else to:
- copy, recreate, reverse engineer, decompile or otherwise try to work out the formulas, methods, source code or settings behind our proprietary indicators, levels or tools, including by systematically collecting their output;
- copy, sell, sublicense, rent or commercially exploit any part of the Service;
- remove or hide any notice of ownership, delay label or attribution;
- use our names, logos or indicator names to suggest that we endorse you or your product.
11.4 Open-source parts. Some parts of the Service use open-source software under its own licence. Those licences are listed under "Credits" in the app, and nothing in these terms limits your rights under them.
11.5 Feedback. If you send us ideas, suggestions or feature requests, we may use them freely without paying you or owing you anything.
12. Your content
12.1 What counts as your content. "Your content" means anything you create or send in the Service, such as Indigo scripts, drawings, layouts and settings, watchlists, alerts, issue reports, feedback, screenshots, and messages to our AI assistants.
12.2 You keep ownership. You keep whatever rights you have in your content.
12.3 Licence to run the Service. You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, display and transmit your content as needed to run, secure, support and improve the Service. For content you share with others (such as a published script or a coach's shared charts), this includes showing it to them as the sharing feature describes.
12.4 Your responsibility. You are responsible for your content. You confirm that you have the rights needed to put it into the Service and to give us the licence above, and that it does not break the law or anyone else's rights.
12.5 Removal. We do not review all content, but we may remove, hide or refuse any content, or stop it being public, if we believe it breaks these terms, the law, or someone's rights, or harms the Service or its users.
13. Indigo scripts and publishing
13.1 Writing scripts. With a paid plan you can write and import Indigo scripts and run them on your charts. Scripts run within limits we set (for example on size, number and computing time), and we may stop any script that exceeds them or that affects the Service.
13.2 Importing. Only import scripts you wrote or have the right to use. Converting a script into Indigo does not give you any rights in it that you did not already have.
13.3 Publishing. If you make a script public, everyone on ChartFIG will be able to find it, add it to their charts, read its code and make a copy. By publishing, you:
- confirm you wrote the script or have the right to publish it on these terms;
- give every ChartFIG user a free, non-exclusive, worldwide licence to use, view, copy and modify it within the Service, for their own use; and
- give us a licence to host, display and distribute it within the Service.
If you stop sharing a script or delete it, we will stop offering it to new users, but copies other users have already made may remain.
13.4 Publishing rules. A published script must not:
- contain code meant to harm the Service or its users, collect other people's data, get around limits or plan restrictions, hide what it does, or overload the Service;
- copy someone else's code without permission, or pretend to be one of our proprietary indicators or use their names;
- promise or imply guaranteed profits, or present itself as investment advice;
- advertise paid products or services, or collect payments or contact details;
- contain offensive, misleading, unlawful or infringing material.
13.5 Published scripts are written by users, not by us. We do not check them for accuracy and they are not advice (see section 8). Use them at your own risk.
14. Coaches, shared charts and the Whop link
14.1 Coach content. Some accounts (coaches) can share their chart setups and drawings with followers. Coach content is educational and expresses the coach's own views. It is not advice from us.
14.2 Linking a Whop membership. You can choose to link a Whop account so that we can check whether you hold a membership that unlocks extra content, such as Peachy Investing coach levels. Linking is optional. When you link, we receive limited information from Whop to confirm your membership (see the Privacy Policy). Whop's own terms govern your Whop account and membership, and we are not responsible for Whop.
14.3 Access depends on both. Coach content may require both a paid ChartFIG plan and an active linked membership. If either ends, the content is locked. Memberships bought through Whop are billed and refunded under Whop's terms, not ours.
15. AI features
15.1 The Service includes features that use artificial intelligence, such as a help and issue desk, a feature-request assistant, and AI-written summaries of companies and economic releases.
15.2 AI can be wrong. AI output is produced automatically. It can be inaccurate, incomplete, out of date or inconsistent, and it may sound confident when it is wrong. It is not investment advice and does not reflect our views. Check anything important yourself.
15.3 What you send. Messages, screenshots and context you send to an AI feature are processed by a third-party AI provider on our behalf to produce a reply (see the Privacy Policy). Do not send passwords, payment details or other sensitive information.
15.4 Fair use. AI features have usage limits. You may not try to make an AI feature break its rules, reveal its instructions or internal information, produce harmful content, or do work unrelated to its purpose, and you may not use its output to build a competing product.
15.5 We may change, limit or withdraw AI features at any time.
16. Acceptable use
You agree not to:
- Automate or scrape. Use bots, scrapers, scripts, crawlers or other automated means to access the Service, collect data or output from it, or download data in bulk, except through features we provide for that purpose.
- Overload or attack. Exceed rate limits, place unreasonable load on the Service, probe or test its security, get around access controls, plan limits or delays, or interfere with other users.
- Share access. Share your account, resell access, or let others see real-time data through your account.
- Break the law. Use the Service for anything illegal, including market manipulation, fraud, or breaching sanctions.
- Misuse other people. Harass, threaten, impersonate or mislead others, or collect information about other users.
- Upload harmful material. Upload malware or content that is unlawful, infringing or abusive.
- Help others do any of the above.
We may set and change rate limits and usage limits to keep the Service fair and stable.
17. Suspension and termination
17.1 By you. You can stop using the Service at any time. Cancel any subscription as described in section 6. To have your account deleted, contact us at support@chartfig.com.
17.2 By us. We may suspend, limit or close your account, or remove access to any feature or data, if we reasonably believe you have broken these terms, an exchange's rules or the law, if your use puts the Service, other users or our data licences at risk, if an exchange or data provider requires it, or if we stop offering the Service. Where it is reasonable and lawful, we will tell you first and give you a chance to fix the problem. We do not have to give notice for serious or repeated breaches, abuse, or security threats.
17.3 What happens after. When your account ends, your right to use the Service stops, any paid access ends, and you must stop using any market data you received through it. Except as section 6.4 says, closing an account for breach does not entitle you to a refund. We handle your data as described in the Privacy Policy.
17.4 What survives. Sections that by their nature should continue after your account ends (including 8, 9, 11, 12.3 for content already shared, 18 to 21) continue.
18. Disclaimers
18.1 As is. The Service, all data, indicators, scripts, AI output and third-party content are provided "as is" and "as available". To the fullest extent the law allows, we make no promises of any kind, express or implied, including that the Service will be accurate, complete, timely, uninterrupted, secure or error-free, or fit for a particular purpose, and no implied warranties of merchantability, fitness for a particular purpose or non-infringement.
18.2 Interruptions. The Service may be unavailable at times, including for maintenance, outages of our suppliers, or events beyond our control. Alerts may arrive late or not at all. Do not rely on them for time-critical decisions.
18.3 Some places do not allow some of these disclaimers. Where that is the case, they apply only as far as the law allows.
19. Limitation of liability
19.1 To the fullest extent the law allows, neither we nor our affiliates, officers, staff, coaches, suppliers, data providers or licensors will be liable for:
- any trading or investment losses, or any decision made or action taken based on the Service;
- any loss of profits, revenue, data, goodwill or opportunity; or
- any indirect, incidental, special, consequential, exemplary or punitive damages,
even if we were told they were possible.
19.2 To the fullest extent the law allows, our total liability for all claims relating to the Service or these terms is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event that gave rise to the claim, and (b) US$100.
19.3 Nothing in these terms limits liability that cannot legally be limited, such as liability for fraud, or for death or personal injury caused by negligence.
20. Indemnity
You agree to defend and compensate us, our affiliates, staff, data providers and the exchanges against claims, losses and reasonable costs (including legal fees) that arise from your breach of these terms, your misuse of market data, your content, or your breach of the law or someone else's rights.
21. Governing law and disputes
21.1 These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-law rules, and by applicable US federal law.
21.2 Talk to us first. If you have a dispute with us, please email support@chartfig.com first and give us 30 days to try to resolve it informally.
21.3 Courts. If it is not resolved, any claim must be brought in the state or federal courts located in the State of North Carolina, and you and we agree to the jurisdiction of those courts. Either of us may bring a claim in a small-claims court if it qualifies.
21.4 If you are a consumer living outside the United States, you may also have rights under the laws of your country that these terms cannot override.
22. General
22.1 Whole agreement. These terms, the Privacy Policy and any feature terms shown in the app are the whole agreement between you and us about the Service.
22.2 Assignment. You may not transfer your rights or duties under these terms. We may transfer ours, for example as part of a sale or reorganisation of our business, as long as your rights are not reduced.
22.3 Events outside our control. We are not responsible for failures or delays caused by events beyond our reasonable control, such as outages of exchanges, data providers, networks or hosting suppliers, natural disasters, or government action.
22.4 Severability and waiver. If part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.
22.5 Notices. We may send you notices by email to the address on your account or in the app. You can send notices to us at support@chartfig.com or by post to 5540 Centerview Dr Ste 204, PMB 796970, Raleigh, North Carolina 27606-8012, United States.
22.6 No agency. These terms do not create any partnership, employment or agency between you and us.
23. Affiliate programme
23.1 Account holders may be offered the chance to join our affiliate programme and earn commission when people they refer subscribe to a paid plan.
23.2 The programme's commission rates, payment timing, eligibility and rules are set out in the programme terms shown in the app when you join, and they apply in addition to these terms.
23.3 In summary: commission is earned only on payments that are actually received and not refunded or reversed; you may not refer yourself, create fake accounts, use spam, misleading claims, paid ads on our brand names, or anything that breaks the law; and you are responsible for your own taxes. We may withhold commission obtained in breach of the rules, and may change or end the programme on notice.
23.4 Affiliates are independent. You may not present yourself as our employee or agent, or make any statement about trading results or investment returns when promoting ChartFIG.
